HosterPK's Terms & Conditions

This Services Agreement (the "Agreement") contains the complete terms and conditions
which govern your use of Web hosting, Domain Registrations, e-commerce,
Dedicated Servers, and other services provided by HosterPK
(the "Services"). In this Agreement, "HosterPK Pakistan", "HosterPK", "we", "us" means HosterPK
Pakistan
and "Client", "you", or "your" means you. By clicking on the "Submit Order" button,
or by buying any of our hosting package,
you acknowledge that you have read the Agreement, and you agree to its terms,
conditions and all policies of HosterPK. Failure to comply with these terms and conditions may result in account suspension or termination, the determination made
at the sole discretion of HosterPK, on a case-to-case basis.
In addition to the following, the Acceptable Use Policies provide more detailed
information regarding what is acceptable use of our products and services.

Refund / Moneyback Policy |
All new web hosting orders for shared hosting include a 30 days refund / moneyback guarantee.
Please find below our refund policy for different services / products offered by
HosterPK:
- Hosting Refund Policy
If you become unsatisfied at any point within the first 30 days usage, we will
offer 100% refund of your money. Refund requests should state clearly the reason
for your refund request and must be received within the 30
days of activation through email (support [at] hosterpk.com), or the web form.
- Domain Refund Policy

HosterPK uses third party domain registrar to register the customer's domains,
so once registered domains cost will not be included in the refund. However you
will be able to retain the ownership of domain, and will be eligible to transfer
your domain to other registrars. Changes to domain name will not be allowed once
it is registered with the registry.
- Other Important Info

Please note that accounts terminated due to violation of our terms and
conditions found below, will not be eligible for the refund. Similarly refund
request will not be accepted if it is requested for any cause that is out of
HosterPK's control e.g. the customers lack of knowledge or experience with web
basics etc. Also the refund is not offered on VPS / dedicated servers.

Acceptable Usage and Content Policy |
HosterPK strictly prohibits any account hosted on our servers from containing certain types of material. These include, but are
not limited to:
- Adult Material
This includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of
HosterPK.
- Illegal Material

This includes any material considered illegal by the governing body e.g.
commercial music, audio, video files, copyrighted material
- Warez
-
This includes pirated, nulled, hacking, ip spoofing, password cracking scripts or software.
- Questionable Material

This includes any material, which is meant to harm, bash, offend, or pull down another group, be it political, religious, racial, sexual, or otherwise.

ICANN Registrant Rights and Responsibilities |
HosterPK Pakistan strives to ensure the domain Registrants and Resellers need are always
fulfilled. You can view
this page to read the ICANN's directions and policies on your rights and
responsibilities as Registrant of domain.

UCE (Unsolicited Commerce Email) - SPAM Policy |
Spamming is the sending of unsolicited e-mail, to persons the sender does not know or have prior consent to send the message to. We have a very strict spam protection policy.
This also includes sending unsolicited advertisements to newsgroups, email addresses and/or generating a high volume of outgoing email. There are many ways that someone can hide their identity on the Internet, and we are aware of these ways, so be assured that your account would not be terminated until we are not fully sure that they have indeed abused our services.
Sending mails through script should always be less than 500 in an hour,
consistant violation of this limit will result in account suspension. Also you
should script your emails to be sent in intervals of at-least 7 to 10 seconds
apart so there is not undue load on the server. Any account found in violation of this will be cancelled immediately.
Please report any instances of spamming to abuse@hosterpk.com, with as much details as possible, by clearly identifying the source of the spam email account.

Disk Space Abuse
The space we provide for hosting should not be used as a storage medium for your files or data. At least 90% of
your web
pages must be 'linked' with files (GIF, JPEG, etc.) stored on HosterPK servers.
Website that are found to contain either/or no HTML documents, a large number of unlinked
files are subject to files deletion or account cancelation.

Account Resources Abuse
Continuous overuse of server resources may also
result in account suspension / termination. Any account using 25% CPU / Memory
resources for more than 60 seconds, resulting from the single or combined use of
FTP, CGI Scripts, HTML or MySql resources will result in account suspension.

Technical Support Boundaries
HosterPK provides technical support for you that encompasses within our area of
expertise only. Such expertise includes assistance, installation, troubleshooting, and debugging, and any other hosting related issues.
However, in under no circumstances is HosterPK neither obligated to help you in
providing assistance for any coding related issues, errors produced by any applications, unless our support team
in its sole discretion is willing to do so.

Backups and Data Loss
You use our services on your own sole risk. HosterPK is not responsible for
files, data residing on your account. YOU AGREE TO TAKE FULL RESPONSIBILITY FOR FILES AND DATA TRANSFERRED AND TO MAINTAIN ALL APPROPRIATE LOCAL BACKUPS OF FILES AND DATA STORED ON HOSTERPK SERVERS.

HosterPK INTERNET SERVICE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS
AND SERVICES AND ALL TEXT, GRAPHICS,
LINKS ARE PROVIDED TO CLIENT ON AN ‘AS IS, AS AVAILABLE’ BASIS AND WITHOUT WARRANTY
OF ANY KIND. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO
HosterPK OR ANY INFORMATION OR SOFTWARE THEREIN. |
Limitation of Liability

YOU RELEASE HosterPK FROM ANY LIABILITY OR RESPONSIBILITY FOR ANY DIRECT, INDIRECT,
CONSEQUENTIAL OR INCIDENTAL DAMAGE SUFFERED BY YOU RELATED TO YOUR USE OF OR INABILITY TO USE
HosterPK SERVICES INCLUDING, BUT NOT LIMITED TO, DAMAGE
FROM LOSS OF DATA RESULTING FROM DELAYS, SERVICE INTERRUPTIONS, MISS-DELIVERIES,
NON-DELIVERIES, OR DUE TO INADVERTENT RELEASE OR DISCLOSURE OF INFORMATION SENT BY YOU EVEN IF THE SAME IS CAUSED BY
HosterPK's OWN NEGLIGENCE. |
